Civil Partnerships

We offer expert advice in relation to the formation and termination of civil partnerships.  In December 2005, the Civil Partnership Act 2004 came into force.  It has taken the law a long time to accommodate the realities of the modern world and afford same sex partners similar if not equal rights as heterosexual partners.

 

Formation of Civil Partnerships

Same sex couples can now enter into civil partnerships. They need to register the partnership.  They cannot get married as such and the registration of a civil partnership cannot take place in religious premises. Hayman Solicitors can advise on civil partnership agreements prior to the registration. 

 

Breakdown of the Partnership

Civil Partnerships are terminated in the same way as a divorce.  The only difference being that a civil partner cannot issue a Petition based on their partner’s adultery.  The courts are able to make the same financial orders for the ending of a civil partnership as it does for divorces.
